Here are the bare bones of it, and it's scary stuff.
We all know that the American government declared a state of emergency after 11 September 2001 - and was officially put in writing on the 14th.
On 10 September 2009 President Obama declared that such a state of emergency will continue.
Congress is supposed to review such states of emergency at least every 6 months, yet it has never done so since 2001.
Such declarations of national emergency come with the ability of the president to appropriate emergency powers and issue presidential directives. Previous presidents have used such powers to the extent that in 1976 Congress wiped the slate clean of nearly 500 directives that effectively created an autocratic presidency. Astonishingly, the Supreme Court tried to cut Congress down to size on this issue. It remains unclear whether those totalitarian directives have come back into force since the 2001 declaration.
Even without them, a large number of Bush's Presidential Directives remain unknown to the general public, Congress and even to members of Congress on the Homeland Security committee!!
OK, I need to know that I've understood this. The President of the USA, by declaring a state of emergency has the power to issue any directive, which becomes part of law, but also has the power to not tell anybody apart from the few people in the shadow government (Continuity of Government). And that's not totalitarianism?
